1. Acceptance of Terms

By accessing or using Rilavek ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, simply do not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION CLAUSE BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND RILAVEK WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

2. Description of Service

Rilavek provides a real-time data pass-through gateway that streams data between designated storage protocols and endpoints (such as FTP, SFTP, HTTP, and S3-compatible cloud storage). We operate strictly as a transmission conduit. File payloads stream in transit directly to your configured destinations and are never stored or retained on our disks.

The Service may include "Beta" features which are provided "AS IS" and may contain bugs or errors. Use of Beta features is at your sole risk.

3. User Responsibilities & Prohibited Conduct

• You are solely responsible for the configuration of your storage endpoints (Sources and Destinations).
• You are responsible for obtaining all necessary rights and permissions to transfer the data you route through the Service.
• You agree not to use the Service for any illegal purposes, including but not limited to transferring validly flagged copyright-infringing material, malware, or illegal content.
• You represent and warrant that your use of the Service will not violate any applicable laws or regulations.
• You agree not to reverse engineer, decompile, or attempt to extract the source code of the Service.
• You agree not to access the Service to build a competitive product.
• You agree not to use excessive resources or attempt to bypass usage limits.

4. Credentials & Storage Security

You are responsible for maintaining the confidentiality of your account credentials and any sender tokens or keys you configure. You represent and warrant that you own or have verified authorization to connect any storage buckets, servers, or endpoints configured in your pipelines. Rilavek is not responsible for any data loss, corruption, or unauthorized access that occurs on your external storage providers or target buckets.

5. Transfer Verification & Third-Party Costs

• Transfer Verification: You are solely responsible for verifying that your file transmissions have completed successfully. Rilavek is a transmission conduit, not a data recovery or long-term archival service. You agree to maintain independent backups of all source files and acknowledge that Rilavek carries zero liability for missing, corrupted, or incomplete files.
• Third-Party Cloud Costs: You are solely responsible for all storage, API request fees, and bandwidth charges incurred on your connected third-party storage providers resulting from your pipeline activity.
• Network Transmission Realities: You acknowledge that file transfers over the internet are subject to connection resets, network drops, and provider rate limits. We do not warrant that transmissions will be instantaneous, uninterrupted, or error-free.

6. Termination

We reserve the right to suspend or terminate your account or access to the Service at any time, for any reason or no reason, without prior notice or liability, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

7. No Warranty ("As Is")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RILAVEK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

To the fullest extent permitted by law, in no event shall Rilavek, its affiliates, or its creators be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

This includes, without limitation, loss of data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall the aggregate liability of Rilavek exceed the greater of fifty U.S. dollars (U.S. $50.00) or the amount you paid Rilavek, if any, in the past six months for the service giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Rilavek and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration. YOU AND RILAVEK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. DMCA & Copyright Policy

Because Rilavek operates strictly as a real-time pass-through transmission gateway and does not store or host customer files, takedown requests regarding files residing on destination storage must be directed to the third-party storage provider hosting the content. However, we respect intellectual property rights and will promptly investigate notices alleging that an account is using our gateway for unlawful purposes. We reserve the right to suspend or terminate access for repeat infringers.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms on this page. Your continued use of the Service after such posting constitutes your consent to be bound by the changes.
